Lixor, nu au cum sa apara probleme. Cu tot respectul te indrum catre wipo.int. Vei vedea ca este fizic imposibil ca un termen neinregistrat international, si generic in limba de referinta, sa iti cauzeze probleme.
Conditiile din WIPO nu sunt indeplinite simultan.
Paragraph 4(a) of the Policy provides that a complainant must cumulatively establish each of the following three conditions to successfully challenge a registered domain name:
(1) that the domain name registered by the Respondent is identical or confusingly similar to a trademark or service mark in which the Complainant has rights
Marca nu este identica, si este un cuvant de referinta in limba statului in cauza. Sunt sute de cazuri in portofoliul WIPO de genul asta unde nu se trece pe criteriu. E ca si cum ai lua www.castravete.ro de la owner, in conditiile in care tu ai Castravete Cardiag inregistrat ca TM. Daca inregistreaza marca de acum inainte, domeniul precede marca ca data de inregistrare.
(2) that the Respondent has no legitimate interests in respect of the domain name;
Iar nu trece, pentru ca exista interese legitime din partea mea.
(3) that the domain name has been registered and is being used in bad faith.
Iar nu trece, pentru ca nu avem bad faith. Gandeste-te ce implicatii ar avea sa avem cuvantul realitate ca TM.

Trademarks are distinctive signs, used to differentiate between identical or similar goods and services offered by different producers or services providers.
Nu vad nimic distinctiv la cuvantul realitate, declinat, folosit per se, adica fara alte simboluri grafice asociate, sau fara particula TV.
